ADR Committee Meeting Minutes
May 1, 2003
David Harwi reported that there were no new developments with respect to Local Rule 53.3 and the related mediation protocol of the Eastern District Court.
There was then a discussion of the status of the state-wide initiative of the Pennsylvania, Philadelphia and Allegheny Bar Associations and the Pennsylvania Council of Mediators to promote the use of ADR in the Commonwealth. A concept paper outlining an approach to accomplish the promotion, similar to the approach developed in Maryland, was to be presented to Leslie Miller of the Office of General Counsel and members of the Supreme Court.
There was a discussion of the upcoming PBI program in June entitled Maximizing your Mediation.
The group then suggested tactics to promote the use of ADR with compensated neutrals among members of the Philadelphia Bar. These included:
  • Publication of articles of 500 words in Bar Association periodicals all of which are looking for such works.

  • Development of a regular ADR column in some publications which might recount vignettes in which ADR techniques were used.

  • Approaching other Sections and Committees of the Bar to determine use of and attitudes toward ADR by their members.

  • An ADR component in all appropriate CLE programs.

  • Joint meeting by conference telephone with the ADR Committee of the Allegheny County Bar Association.
