RESOLUTION SUPPORTING ADEQUATE FUNDING OF THE FEDERAL JUDICIAL SYSTEM

WHEREAS, the Philadelphia Bar Association promotes respect for the rule of law, access to the courts and equal justice for all; and

WHEREAS, the federal judicial system, including the United States Third Circuit Court of Appeals, the Eastern District of Pennsylvania Courts, federal departments, US Attorneys, and the Federal Defender have faced significant staff cuts and faced budget constraints in 2013, as well as a shutdown of the federal government in 2013 which impacted the federal judicial system; and

WHEREAS, it is anticipated that there will be further staff cuts and budget constraints in the future which may also lead to shutdowns of the federal government in the future; and

WHEREAS, an adequate level of funding is necessary for the federal judicial system to carry out its mission of providing fair and impartial justice in a timely manner.

NOW, THEREFORE, BE IT RESOLVED that the Philadelphia Bar Association urges all federal, state, territorial, and local legislative bodies and governmental agencies to adopt laws and policies that ensure full and adequate court funding so that courts can fulfill their constitutional duties;

AND BE IT FURTHER RESOLVED that the Philadelphia Bar Association urges federal elected officials, as they consider deficit reduction for fiscal year 2014 and beyond, to maintain the ability of individuals, as well as business and other organizations, to have access to justice by assuring that the federal judicial system, including the federal courts receive funding adequate to permit them to perform their constitutional functions effectively and efficiently;

AND BE IT FURTHER RESOLVED that the Chancellor and/or the Chancellor's designee(s) communicate the Philadelphia Bar Association's position and take whatever action is necessary to effectuate this resolution.
