SUPPORT FOR EFFORTS TO CURB POSSESSION OF HANDGUNS BY MINORS

WHEREAS, the Philadelphia Bar Association strongly supports efforts to curb possession of handguns by minors and to provide rehabilitative services to juvenile offenders;

WHEREAS, Bill 712 prohibiting Sale to or Possession by Minors of Firearms or Ammunition has been introduced in City Council;

WHEREAS, Bill 712 treats infractions as civil code violations subject to fines without the mandatory rehabilitative services of the Juvenile Court;

WHEREAS, sale to or possession by minors of firearms or ammunition is already prohibited by State statute, 18 Pa.C.S.A. Sections 0907 (Possessing instruments of crime), 0908 (Prohibited offensive weapons), 6106 (Firearms not to be carried without a license), 6108 (Carrying firearms on public streets or public property in Philadelphia), 6110 (Persons to whom delivery shall not be made) and 6302 (Sale or lease of weapons and explosives), where jurisdiction already lies in the Juvenile Court;

NOW, THEREFORE, BE IT RESOLVED that the Philadelphia Bar Association urges the Council of the City of Philadelphia to strongly support efforts to curb possession of handguns by minors and recognize that duplicative enactments like Bill 712 minimize the seriousness of possession of handguns and ammunition by minors and fails to provide for mandatory rehabilitative services of the Juvenile Court;

AND BE IT FURTHER RESOLVED that the Philadelphia Bar Association commend the Council of the City of Philadelphia for its concerns about possession of handguns and ammunition by minors and its interest in juvenile justice.
