PHILADELPHIA BAR ASSOCIATION FAMILY LAW SECTION
RESOLUTION IN OPPOSITION TO SENATE BILL NO. 177

WHEREAS, Senate Bill No. 177, Session of 1999 (Primer's No. 171), was introduced and referred to the Judiciary Committee on January 20, 1999;

WHEREAS, this Bill addresses the issue of partial custody and visitation rights for grandparents and great-grandparents;

WHEREAS, 23 Pa.C.S.A. §§ 5311-5314 adequately protect the rights of grandparents and great grandparents to petition for custody, partial custody or visitation in specific circumstances, such as when one natural parent is deceased, or where the parents are separated or divorced;

WHEREAS, the proposed legislation would allow grandparents and great grandparents to file custody actions against the parents of children in an intact family, which would be disruptive to that family and therefore not in the best interest of the children;

NOW, THEREFORE BE IT RESOLVED that the Philadelphia Bar Association opposes the passage of Senate Bill 177 as presently written or other comparable legislation;

AND BE IT FURTHER RESOLVEDthat the Chancellor, staff and Legislative Liaison Committee shall use their best efforts to communicate this position to lawmakers and to effectuate this resolution.
