RESOLUTION URGING ADOPTION OF THE REPORT AND
RECOMMENDATION OF THE
FEDERAL COURTS COMMITTEE
ON THE PROPOSED AMENDMENTS TO THE
FEDERAL RULES OF CIVIL PROCEDURE
AND THE FEDERAL RULES OF EVIDENCE

WHEREAS, the judicial conference advisory committees on the federal civil rules and federal evidence rules have proposed amendments to various rules and are seeking public comment on the proposed changes by February 1, 1999;

WHEREAS
, the Federal Courts Committee created a subcommittee to review the proposed amendments and make recommendations;

WHEREAS
, the rules amendments would become effective on December 1, 2000, or later, if - following the public comment period - they are in turn approved, with or without revision, by the relevant advisory committee, the standing committee, the judicial conference, and the Supreme Court, and if they are not altered by Congress;

NOW, THEREFORE, BE IT RESOLVED
, that the Philadelphia Bar Association support and adopt the recommendations of the Federal Courts Committee on the proposed amendments to the Federal Rules of Civil Procedure, Rules 26(a)(1), 26(a)(3) and (5)(d), 26(b)(1), 26(b)(2), 26(f), 30(d), 34(b), 37(c)(1), (4) and (12), and on the proposed amendments to the Federal Rules of Evidence, Rule 103, 701, 702, 703, 803(b) and 902(11);

AND BE IT FURTHER RESOLVED
, that the Chancellor is hereby authorized to communicate this position of the association to the administrative office of the U.S. Courts.
