RESOLUTION SUPPORTING THE CONTINUATION AND PRESERVATION OF ADMINISTRATIVE LAW JUDGE DE NOVO REVIEW OF APPLICATIONS FOR SOCIAL SECURITY DISABILITY AND SUPPLEMENTAL SECURITY INCOME BENEFITS

WHEREAS, it is the unanimous consensus of the Philadelphia Bar Association's Social Security Disability Committee that a de novo hearing, processed before an administrative law judge, is necessary to safeguard the due process rights of Social Security Disability/Supplemental Security Income claimants seeking benefits under each of those programs;

WHEREAS, it is the consensus of the Committee that the statutory mandates establishing the Social Security Disability and Supplemental Security Income programs can be fairly, properly and lawfully administered only through providing a de novo review, by an administrative law judge, of an administrative denial of benefits;

NOW, THEREFORE, BE IT RESOLVED that the Philadelphia Bar Association authorizes the Chancellor, or his designee, to take all steps necessary to communicate this enacted resolution to the Commissioner of the Social Security Administration so that the legal rights of claimants seeking Social Security Disability and Supplemental Security Income benefits can be protected and preserved.
