URGING THAT DISCOVERY BE ALLOWED IN DOMESTIC RELATIONS MATTERS

WHEREAS, the Family Law Section of the Philadelphia Bar Association has historically favored the right to discovery in actions of divorce or annulment and actions for support or custody of minor children;

WHEREAS, theSupreme Court of Pennsylvaniais charged with promulgating Rules of Court;

WHEREAS, the Supreme Court of Pennsylvania has promulgated the right to discovery in any civil action or proceeding at law or in equity brought in, or appealed to any Court in Pennsylvania, except for actions of divorce or annulment, actions for support or custody of minor children, pursuant to Pa. Rule of Civil Procedure 4001, et seq.;

WHEREAS, actions involving families and/or the dissolution of the marriage most importantly require the full and open disclosure of all pertinent information;

NOW, THEREFORE, BE IT RESOLVED, the Philadelphia Bar Association recommends that the Supreme Court of the Commonwealth of Pennsylvania amend the Rules of Civil Procedure to allow for full discovery in all domestic relations matters and concomitantly the deletion of Pennsylvania Rule of Civil Procedure 4001(a)(2).
