RESOLUTION SUPPORTING THE GUARANTEED FEE SYSTEM

WHEREAS, the First Judicial District of Pennsylvania implemented the Guaranteed Fee System for Court Appointed Counsel in 1994;

WHEREAS, the Guaranteed Fee System has strengthened the constitutional right to effective representation by counsel, has provided for better and more timely payment for court-appointed attorneys, has provided for improved availability and payment of investigators and experts in court appointed cases, has removed judges from direct approval of counsel fees, and has provided budgetary predictability for the court administration;

WHEREAS, the Guaranteed Fee System is scheduled to expire on June 30, 1996;

NOW, THEREFORE, BE IT RESOLVED by the Philadelphia Bar Association that the First Judicial District of Pennsylvania is urged to readopt the Guaranteed Fee System subject to revisions on a permanent basis;

AND BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the president judge of the Court of Common Pleas, the administrative judge of the Trial Division of the Court of Common Pleas, the administrative judge of the Family Court Division of the Court of Common Pleas, the president judge of the Philadelphia Municipal Court and the other appropriate administrators for the First Judicial District of Pennsylvania.
