COMMENTS RE THE PROPOSED INSTITUTIONS OF PURELY PUBLIC CHARITY ACT
NOW, THEREFORE, BE IT RESOLVED that the Board of Governors believes that it is appropriate for the General Assembly to codify and quantify the constitutional and statutory provisions regarding purely public charities.
AND BE IT FURTHER RESOLVED that the Board of Governors makes certain technical suggestions for improving the proposed statutory provisions that deal with the five criteria established by the courts in the Hospital Utilization Project case.
AND BE IT FURTHER RESOLVED that the Board of Governors urges the General Assembly to closely review whether the $100,000 salary cap for Philadelphia institutions is constitutional.
AND BE IT FURTHER RESOLVED that the Board of Governors identifies a number of procedural and administrative problems that need to be addressed in the bill.
AND BE IT FURTHER RESOLVED that the Board of Governors approves and adopts the reportof the Philadelphia Bar Association Tax Section (State and Local Tax Committee) dated February 21, 1996.
