REQUEST FOR REPRESENTATION ON FIRST JUDICIAL DISTRICT'S ADMINISTRATIVE GOVERNING BOARD

WHEREAS, the Administrative Governing Board of the First Judicial District has issued a directive governing counsel fees for assigned counselwhich modifies the Guaranteed Fee System;

WHEREAS, the Administrative Governing Board did not invite the participation of the Criminal Justice Section in developing this counsel fees directive, unlike the cooperative effort between the bench and bar in developing the Guaranteed Fee System;

WHEREAS, there is a history of a good working relationship between the bench and bar in state court, and the Administrative Governing Board's failure to include Criminal Justice Section representatives threatens to harm this relationship;

NOW, THEREFORE, BE IT RESOLVED that the Philadelphia Bar Association requests that the Administrative Governing Board include permanent Criminal Justice Section representation in meaningful negotiations revolving around counsel fees, performance standards, and other matters relative to legal representation in the state courts;

AND BE IT FURTHER RESOLVED that the Chancellor is empowered to take any and all action on behalf of the Philadelphia Bar Association that may be necessary and appropriate to implement the terms of this resolution.
