RESOLUTION URGING THE U.S. SENATE JUDICIARY COMMITTEE TO CONSIDER PROMPTLY THE NOMINATION OF HON. FREDERICA MASSIAH-JACKSON TO THE U.S. DISTRICT COURT FOR THE EASTERN DISTRICT OF PENNSYLVANIA
WHEREAS, Philadelphia Common Pleas Court Judge Frederica Massiah-Jackson has been a respected member of the Philadelphia Bench;
WHEREAS, there are at present four (4) judicial vacancies on the U.S. District Court for the Eastern District of Pennsylvania ("Eastern District"), creating hardships for those judges currently serving, as well as for lawyers and litigants within the court system;
WHEREAS, Judge Massiah-Jackson has been nominated by President Clinton to fill an existing vacancy on the bench of the Eastern District;
WHEREAS, Pennsylvania's United States Senators, Hon. Arlen Specter and Hon. Rick Santorum are fully supportive of Judge Massiah-Jackson's nomination;
WHEREAS, Judge Massiah-Jackson's background, judicial record and qualifications have been investigated and found satisfactory by 1) the Philadelphia Bar Association's Commission on Judicial Selection and Retention, 2) the American Bar Association, and 3) the Federal Bureau of Investigation;
WHEREAS, Chancellor Clifford E. Haines has responded to media inquiries regarding Judge Massiah-Jackson's nomination to the federal bench and her record and reputation while sitting as a judge of Philadelphia's Common Pleas Court, stating:
We know Judge Massiah-Jackson to be someone who demonstrates many of the important qualities a judge should have. She's bright. She's articulate. She's compassionate and in addition she represents the minority community - something our federal courts are sorely in need of.
NOW, THEREFORE, BE IT RESOLVED that the Board of Governors of the Philadephia Bar Association concurs with the statement of Chancellor Haines, noting specifically the existing vacancies on the Eastern District bench;
AND BE IT FURTHER RESOLVED that the Board of Governors urges the U.S. Senate Judiciary Committee to proceed without delay to a full and fair hearing on Judge Massiah-Jackson's nomination to be and qualifications to serve as a judge of the U.S. District Court for the Eastern District of Pennsylvania.
