RESOLUTION INCORPORATING THE FEE DISPUTES COMMITTEE MEDIATION PROGRAM
INTO THE OPERATING RULES OF THE FEE DISPUTES COMMITTEE

WHEREAS , the Philadelphia Bar Association has long recognized the need for a program to resolve disagreements between clients and attorneys over fees charged for legal services confidentially and out of court;

WHEREAS , the Philadelphia Bar Association has established a Fee Disputes Committee, the purpose of which is stated in Section 714 of the Association's Bylaws as follows: "The Committee on Fee Disputes shall concern itself with disputes concerning the amount of fees charged by any member of the Philadelphia Bar in eases in which no unethical conduct is alleged.";

WHEREAS, the work of the Fee Disputes Committee has increased to the point where it is handling over 125 cases per year through its arbitration process;

WHEREAS, in response to this growth, the Fee Disputes Committee drafted the Fee Disputes Committee Operating Rules, which were adopted by the Philadelphia Bar Association Board of Governors on November 16, 1995;

WHEREAS, the Fee Disputes Committee Operating Rules provide arbitration as the only avenue of alternative dispute resolution available to parties;

WHEREAS , mediation has become an increasingly popular and successful means of resolving disagreements between parties seeking an alternative to litigation;

WHEREAS , the Executive Board of the Fee Disputes Committee believes that the effectiveness of the Committee will be enhanced by the addition of a mediation option to its program;

WHEREAS , the Executive Board of the Fee Disputes Committee has decided that a mediation program should be instituted on a trial basis to determine its effectiveness;

WHEREAS , the Fee Disputes Committee has worked closely with the Philadelphia Bar Association's Alternative Dispute Resolution Committee in drafting rules for the mediation of fee disputes;

WHEREAS , on September 10, 1998, the Executive Board of the Fee Disputes Committee approved the "Fee Disputes Committee Mediation Program," attached hereto as Exhibit A, and the language of this Resolution;

THEREFORE, BE IT RESOLVED that the Board of Governors of the Philadelphia Bar Association approves the "Fee Disputes Committee Mediation Program," attached hereto as Exhibit A, and incorporates said mediation program into the existing Operating Rules of the Fee Disputes Committee for a period of one year, beginning January 1, 1999, and ending December 31, 1999, unless further extended by Resolution of the Board of Governors.
