COURT APPOINTMENT FEES AND EXPERTS & INVESTIGATORS PANEL
WHEREAS, there is a need to change and reform the court appointed system for indigent and criminal defendants in Philadelphia County due to the difficulty in obtaining experts and investigators, the lack of timeliness of payment of experts, investigators, and counsel, and the inadequacy of payment of experts, investigators and counsel and since every criminal defendant is entitled to the Sixth Amendment right of effective assistance of counsel and the Fifth and Fourteenth Amendment rights of due process and equal protection, the Board of Governors of the Philadelphia Bar Association and the Criminal Justice Section of the Philadelphia Bar Association hereby adopts and approves the changes to the method of compensation for attorneys representing indigent criminal defendants in Philadelphia County as set forth in the final report, which also includes payment within thirty (30) days and further, adopts and approves the concept of a panel of investigators and experts be available for the use of court appointed counsel. Further, it is respectfully contended that this system be implemented by July 1, 1993.
