SUPPORT FOR MOVING THE YOUTH STUDY CENTER CLOSER TO FAMILY COURT
 
WHEREAS, the City of Philadelphia has decided to move the Youth Study Center from its present location;

WHEREAS, the Philadelphia Bar Association supports the relocation of the Youth Study Center to an area in close proximity to Family Court;

WHEREAS, the Philadelphia Bar Association recognizes that the Juvenile Act requires that in cases where the juvenile is held in detention or in shelter care, that a hearing be set no later than ten (10) days after the petition is filed, and that if the hearing is continued, the child shall be released, except in cases where the Court finds sufficient grounds under strict standards for the child to be held for an additional single period of up to ten (10) days;

WHEREAS, the Philadelphia Bar Association recognizes that a move of the facility to Northeast Philadelphia will cause additional continuances and an increased backlog of cases because of the difficulty in court personnel visiting the facility and appearing in court within a short period of time;

WHEREAS, the Philadelphia Bar Association recognizes the objective of providing treatment, supervision or rehabilitation: for a delinquent child will become more difficult to achieve due to the less likelihood of prompt intervention and screening by court agencies such as the Probation Department, the Department of Human Services, the Dispositional Planning Unit, and court psychologists providing Mental Health Assessment of juveniles;

WHEREAS, the Philadelphia Bar Association recognizes that a move of the facility to Northeast Philadelphia will create further expenses for additional Sheriffs and vehicles to transport the juveniles from the facility to Juvenile Court, an increase in insurance liability, and an increase in continuances due to transportation difficulties;

WHEREAS, the Philadelphia Bar Association recognizes that a move of the facility to Northeast Philadelphia will cause great inconvenience to the families of detained juveniles in terms of visitation of detention hearings;

WHEREAS, the Philadelphia Bar Association recognizes that a move of the facility to Northeast Philadelphia will cause additional expenditures for Court appointed counsel for the time involved visiting detained juveniles and attending detention hearings, and additional inconveniences for private attorneys and public defenders for visitation and detention hearings;

NOW, THEREFORE, BE IT RESOLVED that the Philadelphia Bar Association opposes relocation of the Youth Study Center to the prison complex on State Road in Northeast Philadelphia;

AND BE IT FURTHER RESOLVED that the Philadelphia Bar Association favors the location of any secured detention facility for juveniles at a site close to the Family Court building at 1801 Vine Street.
