AUTHORIZING THE FORMATION OF A NONPROFIT CORPORATION TO BECOME THE CAPITAL CASE RESOURCE CENTER
 
WHEREAS, the Philadelphia Bar Association supports the establishment of a Capital Case Resource Center in Pennsylvania (hereinafter referred to as the Resource Center), as reflected in a Board resolution adopted on May 20, 1993;

WHEREAS, said resolution authorizes the Chancellor to seek funding for the Resource Center;

WHEREAS, the Chancellor has been advised by representatives of the Administrative Office of the Federal Courts and the American Bar Association Post-Conviction Death Penalty Representation Project that a nonprofit tax exempt corporation must be formed to receive federal funds for the Resource Center and that the Philadelphia Bar Association may file an application with the Administrative Office for such funds during the interim before the nonprofit corporation is formed;

WHEREAS, the Chancellor, pursuant to the aforesaid May 20 resolution intends to file such an application with the assistance of the American Bar Association Post-Conviction Death Penalty Representation Project;

NOW, THEREFORE, BE IT RESOLVED that the Board of Governors of the Philadelphia Bar Association hereby authorizes the creation of a nonprofit corporation under the Pennsylvania Nonprofit Corporation Law of 1988, as amended, to be named the Pennsylvania Capital Case Resource Center or such other name as may be appropriate and authorizes the provision of assistance through the Philadelphia Bar Association for such nonprofit corporation to seek and obtain a tax exemption under Section 501(c)(3) of the Internal Revenue Code of 1986, as amended.
