RESOLUTION TO ADOPT THE REVISED RULES OF THE LAWYER-CLIENT FEE DISPUTE RESOLUTION PROGRAM

WHEREAS, the Philadelphia Bar Association has established a Fee Disputes Committee, the purpose of which is to seek to resolve disputes concerning the amount of fees charged by lawyers in cases in which no unethical conduct is alleged;

WHEREAS, in response to this mandate, the Fee Disputes Committee has operated a successful program to resolve disputes between clients and attorneys over fees charged for legal representation;

WHEREAS, the Executive Board of the Fee Disputes Committee has recognized a need to improve the program's effectiveness by making it more user friendly for clients and lawyers and by making it more efficient to administer;

WHEREAS, in response to this need, the Executive Board of the Fee Disputes Committee has drafted revised Rules for the Lawyer-Client Fee Dispute Resolution Program;

WHEREAS, the Executive Board of the Fee Disputes Committee has approved the "Lawyer-Client Fee Dispute Resolution Program" attached hereto as Exhibit A.

NOW, THEREFORE, BE IT RESOLVED that the "Lawyer-Client Fee Dispute Resolution Program" in the form attached hereto as Exhibit A is hereby approved and shall be effective commencing January 1, 2004, for all new cases filed on or after January 1, 2004. The Executive Board of the Fee Disputes Committee shall have the discretion to revise the Exhibits to the Rules, so long as any revisions are consistent with the Rules.
