PHILADELPHIA BAR ASSOCIATION RESOLUTION IN FAVOR OF MOVING WORKERS' COMPENSATION HEARING ROOMS FROM THE STATE OFFICE BUILDING AT BROAD AND SPRING GARDEN STREETS

WHEREAS, members of the Philadelphia Bar Association's Workers' Compensation Section, including workers' compensation judges, have expressed dissatisfaction with the facilities at the Philadelphia State Office Building for workers' compensation hearings;

WHEREAS, the security at the State Office Building for hearing rooms is inadequate;

WHEREAS, the judges share bathroom facilities with litigants and members of the general public;

WHEREAS, judges must enter their courtrooms by passing through hallways crowded with litigants, witnesses, and attorneys;

WHEREAS, judges must enter their courtrooms through the same doors as litigants and witnesses and proceed through a room crowded with litigants and witnesses in order to be seated at the bench;

WHEREAS, judges have no safe exit in the event witnesses or litigants become unruly;

WHEREAS, the metal detecting machine has been approved for screening litigants for weapons it has not been installed as there is insufficient space for its placement;

WHEREAS, the inadequate ventilation in the courtrooms makes them uninhabitable in warm weather;

WHEREAS, there is insufficient space available within the State Office Building in Philadelphia to establish a safe and secure environment within which to hold workers' compensation hearings;

NOW, THEREFORE, BE IT RESOLVED that the Philadelphia Bar Association, for the reasons above stated, endorses a proposal to remove the workers' compensation hearing rooms in Philadelphia to a central location accessible to public transportation, suited to provide a secure environment within which hearings can be held, and allows judges to have separate bathroom facilities and separate entrances from those used by witnesses and litigants;

AND BE IT FURTHER RESOLVED that the Philadelphia Bar Association authorizes the Chancellor to take all necessary steps to publicize the Association's position as reflected in this resolution and to inform the Secretary of Labor and Industry, the Governor of the Commonwealth of Pennsylvania and other officials of the importance of moving the hearing rooms for workers' compensation matters to a safe and secure location.
