RESOLUTION OF THE BOARD OF GOVERNORS
OF THE PHILADELPHIA BAR ASSOCIATION

WHEREAS, there is presently pending in the General Assembly of the Commonwealth of Pennsylvania Senate Bill 5, known as the "Lawsuit Abuse/Civil Justice Reform Act" or "S.B. 5";

WHEREAS, S.B. 5 proposes to amend Title 42 (Judiciary and Judicial Procedure) of the Pennsylvania Consolidated Statutes to change significantly the procedural and substantive rights of parties engaged in tort litigation in the Commonwealth of Pennsylvania;

WHEREAS, the State Civil Committee of the Philadelphia Bar Association created a Subcommittee of its members, comprised of members of the plaintiff bar and members of the defense bar, to review and analyze S.B. 5 and to report its findings to the full Committee;

WHEREAS, the Subcommittee met for several sessions and did conduct an extensive review and analysis of each of the provisions of S.B. 5, and issued a report of its findings which was circulated to the entire membership;

WHEREAS, at a meeting of the State Civil Committee held on July 29, 1999, the Subcommittee's report was presented to the full Committee for discussion and evaluation; and

WHEREAS, the State Civil Committee unanimously voted that S.B. 5 should not be passed and recommended that the Board of Governors oppose the enactment of S.B. 5 in accordance with the Subcommittee's report, a copy of which is attached hereto and incorporated herein by reference.

NOW THEREFORE, the Board of Governors hereby adopts the following resolution:

RESOLVED:

1. The Board of Governors of the Philadelphia Bar Association urges the Pennsylvania General Assembly to reject Senate Bill 5, Printer's Number 659, or any similar amendatory language to any other legislation, or any similar proposed Supreme Court Rule change.

2. The Chancellor is hereby authorized to convey this resolution to the Legislature and to the Governor, and to otherwise disseminate this resolution and the Report of the State Civil Committee on Senate Bill 5 as he deems appropriate.
