RESOLUTION TO INCORPORATE THE FEE DISPUTES COMMITTEE MEDIATION PROGRAM
INTO THE OPERATING RULES OF THE FEE DISPUTES COMMITTEE

WHEREAS, the Philadelphia Bar Association has established a Fee Disputes Committee, the purpose of which is stated in Section 714 of the Association’s By-laws as follows: "The Committee on Fee Disputes shall concern itself with disputes concerning the amount of fees charged by any member of the Philadelphia Bar in cases in which no unethical conduct is alleged.";

WHEREAS, the Fee Disputes Committee Operating Rules, adopted by the Philadelphia Bar Association Board of Governors on November 16, 1995, provides for the resolution of lawyer-client fee disputes by arbitration only;

WHEREAS, mediation has become an increasingly popular and successful means of resolving disagreements between parties seeking an alternative to litigation;

WHEREAS, the Fee Disputes Committee, in cooperation with the Alternative Dispute Resolution Committee, has drafted rules for the mediation of lawyer-client fee disputes;

WHEREAS, on November 24, 1998, the Association Board of Governors approved the "Fee Disputes Committee Mediation Program", attached hereto as Exhibit A, as a pilot program for one year, commencing January 1, 1999 and ending December 31, 1999;

WHEREAS, the Executive Board of the Fee Disputes Committee has closely monitored the administration and performance of the Fee Disputes Committee Mediation Program during the pilot year;

WHEREAS, the Executive Board of the Fee Disputes Committee has determined that the Fee Disputes Mediation Program has been effective in bringing about the amicable resolution of disagreements between lawyers and clients over fees charged for legal representation;

NOW, THEREFORE, BE IT RESOLVED that the Board of Governors of the Philadelphia Bar Association approves the "Fee Disputes Committee Mediation Program", attached hereto as Exhibit A, and incorporates said mediation program into the existing Operating Rules of the Fee Disputes Committee. The Fee Disputes Committee may amend the Operating Rules from time to time to enhance the effectiveness of its mission to resolve lawyer-client fee disputes.
