RESOLUTION TO ADOPT THE
LAWYER FEE DISPUTE RESOLUTION PROGRAM

WHEREAS, the Philadelphia Bar Association has established a Fee Disputes Committee, the purpose of which is stated in Section 714 of the Association’s By-laws as follows: "The Committee on Fee Disputes shall concern itself with disputes concerning the amount of fees charged by any member of the Philadelphia Bar in cases in which no unethical conduct is alleged.";

WHEREAS, in response to this mandate, the Fee Disputes Committee administers a highly successful program to resolve disputes between lawyers and clients over fees charged for legal representation;

WHEREAS, the Fee Disputes Committee receives numerous requests for assistance from Association members to resolve disagreements between lawyers over legal fees;

WHEREAS, the Executive Board of the Fee Disputes Committee believes that the addition of a program to resolve disagreements between lawyers over legal fees will offer lawyers an attractive alternative to court action, promote fidelity in the legal profession and enhance the advantages of membership in the Association;

WHEREAS, the Fee Disputes Committee has worked closely with the Pennsylvania Bar Association and this Association’s Alternative Dispute Resolution Committee in drafting rules for the mediation and/or arbitration of fee disputes between lawyers;

WHEREAS, the Executive Board of the Fee Disputes Committee has approved the "Lawyer Fee Dispute Resolution Program," attached hereto as Exhibit A;

NOW, THEREFORE, BE IT RESOLVED that the Board of Governors of the Philadelphia Bar Association approves the "Lawyer Fee Dispute Resolution Program," attached hereto as Exhibit A, to be administered by the Fee Disputes Committee.
