Resolution Supporting Submission of Comments and Proposed Amendments to Pennsylvania Rule of Appellate Procedure 1925(b) to the Appellate Court Procedural Rules Committee of the Pennsylvania Supreme Court

WHEREAS, current practice under Rule 1925(b) of the Pennsylvania Rules of Appellate Procedure has been a persistent source of controversy and confusion for members of the bar;

WHEREAS, the Philadelphia Bar Association Appellate Courts Committee created a subcommittee to study Rule 1925 and to propose amendments that would alleviate the problems with the rule as recognized by members of the bar;

WHEREAS, the Allegheny County Bar Association Appellate Practice Committee and the Pennsylvania Bar Association Appellate Advocacy Committee also recognized problems with current practice under Rule 1925(b);

WHEREAS, the Chairs of the Philadelphia Bar Association Appellate Courts Committee, the Allegheny County Bar Association Appellate Practice Committee, and the Pennsylvania Bar Association Appellate Advocacy Committee appointed an ad hoc task force to draft a joint proposed amendment to Rule 1925(b), for submission to the Appellate Court Procedural Rules Committee of the Pennsylvania Supreme Court;

WHEREAS, the comments and proposed amendments of the ad hoc task force were considered and adopted by the Philadelphia Bar Association Appellate Courts Committee.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Governors adopts the comments and proposed amendments to Pennsylvania Rule of Appellate Procedure 1925(b).

AND BE IT FURTHER RESOLVED that the Board of Governors supports the submission of the comments and proposed amendments to Rule 1925(b) of the Pennsylvania Rules of Appellate Procedure to the Appellate Court Procedural Rules Committee of the Pennsylvania Supreme Court.

AND BE IT FURTHER RESOLVED that the Chancellor is hereby authorized to communicate this position to the Appellate Court Procedural Rules Committee of the Pennsylvania Supreme Court.
