Resolution In Support of the American Bar Association Policy Urging Lawyers to Plan for Practice Continuity

WHEREAS, the Philadelphia Bar Association recognizes the need for lawyers to plan for the succession or the transition of their practice in the case of their disability or death;

WHEREAS, the Philadelphia Bar Association Board of Governors adopted a resolution brought by the Senior Lawyers Professional & Public Service Committee, dated January 23, 2007, establishing a “Program of Assistance” to pair volunteers with attorneys who require assistance in the continuity of their practice, due to disability caused by medical emergency, or death;

WHEREAS, the American Bar Association is urging bar associations to adopt policies that will encourage lawyers to preplan for circumstances that require assistance with the continuity of their practice and to designate in advance another lawyer who would be willing and able to assist in the transition or termination of the lawyer’s practice.

NOW THEREFORE BE IT RESOLVED, that the Philadelphia Bar Association supports the American Bar Association’s resolution urging lawyers to develop plans for the continuity of their practice in the event of their death or disability.

AND BE IT FURTHER RESOLVED, that the Philadelphia Bar Association ABA Delegates are requested to vote in favor of this ABA resolution at the 2007 annual meeting of the American Bar Association.
