Resolution Adopting Amendments to the Lawyer Referral and Information Service Operating Rules and the Procedures for Appeal to the Board of Governors from Suspensions or Removals from the Lawyer Referral and Information Service

WHEREAS, the Philadelphia Bar Association’s Lawyer Referral and Information Service (“LRIS” or “the Service”) provides a vital service to the public and the legal profession by providing referrals of potential clients to attorneys in private practice; and

WHEREAS, LRIS seeks to maintain the high quality of the Service by maintaining membership requirements for lawyers who apply for panel membership with LRIS; and

WHEREAS, Rule 7 of the ABA Model Supreme Court Rules Governing Lawyer Referral Services provides:

“The service must establish procedures for the admission, suspension or removal of a lawyer from any panel. The procedures must be clearly articulated in the service's materials. The procedure may include peer review, but other procedures are permissible. The procedure must include an appeal process.” and

WHEREAS, LRIS, as an ABA-approved lawyer referral service, provides a process for a hearing before the LRIS Committee for panel attorneys who have been suspended or removed from the Service, and a further right of appeal to the Board of Governors following an adverse ruling of the LRIS Committee; and

WHEREAS, the LRIS Committee, in an ongoing effort to improve the Service, to comply with ABA standards and to protect the due process rights of applicants for panel membership, has proposed amendments to the LRIS Operating Rules, attached hereto as Exhibit A, regarding discretionary denial of panel membership, procedures for appeal from denial of panel membership to the LRIS Committee, and further right of appeal to the Board of Governors following an adverse ruling by the LRIS Committee; and

WHEREAS, the LRIS Committee has proposed amendments to the Procedures for Appeal to the Board of Governors from Suspensions or Removals from the Lawyer Referral and Information Service, attached hereto as Exhibit B, to incorporate procedures for appeal to the Board of Governors from adverse decisions of the LRIS Committee regarding denial of panel membership.

NOW, THEREFORE, BE IT RESOLVED that the Board of Governors of the Philadelphia Bar Association adopts the amendments to the LRIS Operating Rules and the Procedures for Appeal to the Board of Governors from Suspensions or Removals from The Lawyer Referral and Information Service, as proposed to the Board of Governors.
