RESOLUTION ENDORSING INCREASED COURT APPOINTED COUNSEL FEES

WHEREAS, the Administrative Governing Board of the First Judicial District uses a Modified Guaranteed Fee System which dictates predefined rates for court appointed counsel fees in Philadelphia;

WHEREAS, this system historically has not been able to adequately ompensate court appointed attorneys;

WHEREAS, when compared nationally, court-appointed counsel fees in Philadelphia are among the lowest in the nation, equal to Tennessee and Idaho;

WHEREAS, in years past, the Philadelphia Bar Association leadership, its Criminal Justice Section and others have endeavored to address the manner and amount of court appointed counsel fees in Philadelphia;

WHEREAS, the rate of court appointed counsel fees in Philadelphia remains oppressively low.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Governors of the Philadelphia Bar Association supports the need for an increase in court appointed counsel fees.

AND BE IT FURTHER RESOLVED, that the Chancellor is authorized to immediately convene a special committee to study the procedures, process and rates of court appointed counsel fees.

AND BE IT FURTHER RESOLVED, that the Chancellor is authorized to work with the affected Sections of the Bar and the special committee to seek an increase in court appointed counsel fees.
